Your spouse already lives lawfully in France under their own residence permit? French law allows them, by way of exception, to benefit from family reunification without returning to their home country to apply for a visa. The conditions are strict, however, and some prefectures still apply restrictive readings of the rule.
LexCase’s Immigration & International Mobility team has published an English-language information note for international families and employers. It sets out the rule under Article R. 434-6 CESEDA and the residence, resources and housing requirements. It also covers the Lyon Administrative Court of Appeal’s ruling of 10 June 2026, which held that the place of marriage is irrelevant. It closes with our practical advice for building a robust file, including when processing times reach up to 18 months.
