UE family member and immigration permits in France

EU family members who are financially dependent to a EU citizen living in one Member States can be granted a permit to stay. This right is based on the financial dependency existing between the EU citizen and his/her family member (as father or mother or descendants over 21 living in a non EU country). This is the case for a German citizen, living in France, with a Father or Mother living in Turkey for instance. EU law underlines that it is not necessary to prove that the dependent cannot work and earn its own finance in his/her home country as the financial dependency is the most important criteria for the delivery of the immigration permit to the benefit of the EU family member (CJUE, 16 janv. 2014, Aff. C-423/12 Reyes c/ Migrationsverket).
